“Every man who comes against the law must be punished.”
But what if it is by an accident? Do we need to castigate or be castigated?
Last night, I’ve seen news about a collision of a ten wheeler truck and a bus. And it happened as if it was destined to leave no one alive and it shocked the hell out of me. I saw many people died because of this. I saw their families crying their lungs out. As if it will bring their loved ones back to life. And I saw the old poor man who is suspected to cause the disaster was already behind bars. The BUS DRIVER. Who just wanted to earn and feed his family was already convicted and punished by our law. He is starting to pay the crime he never planned to happen, the crime even the law has not yet proven.
But WAIT A MINUTE “kapeng maiinit!”
What do mean by the word ACCIDENT?
For me, it is an event which is UNEXPECTED! UNPLANNED! No one knows it will happen! And no one desires it to happen! When I saw the driver in jail, the only thing I felt was mercy and sympathy for the misfortune that he his suffering.
Imagine this! People!! Let’s just say. YOU are the driver and definitely you are also inside the bus during that time and YOU know that if you are going to beat a ten wheeler truck BY INTENTION probably you will be the first one to die. NOT YOUR PASSENGERS!! NO ONE wants to die! And yet the bus driver was sentenced “wreck less imprudence resulting to multiple homicides” and a LIFETIME imprisonment! Oh c’mon!
Do you believe that it is really the driver’s fault? Investigation shows that the driver was not using any forbidden drugs, not drunk or even sleepy. No overloading too. Our Government punished the man because they believe that the accident was the driver’s responsibility and YES I agree that it is the driver’s responsibility to take care of his passenger. I believed that the driver exerted his 100% to save lives. But again it is an ACCIDENT.
To be punished that way was severely UNLAWFUL!! Be logical. Don’t be bias.
What I want from our government is to have considerations, and to make the punishments LIGHTER in this type of incident. Because for the nth time. No one wants this to happen!
I might be saying this out of pity. Yes, the driver is pathetic; he doesn’t have someone on his side. Or perhaps, I’m seeing the face of prejudice as the basis of justice.

That is what I believed. We are engaged in different professions and we should face what might happen through out the course of our job. YES! YOU ARE DEFINITLY RIGHT that the driver is really misfortunate for he did not intend to break the law and he dooesnt have any intentions in doing the act. Even though that it is unplanned or unexpected which you are saying, he still break the law.
I REPEAT LAW IS LAW AND THERE IS NO EXCEPTION
the driver had killed lives. took away souls that have plenty of dreams they want to fulfill in their lifetime. But we can't hold the future. We can only predict but never can make a hundred percent assurance regarding the certainty of the prediction. You can argue saying, "the driver doesnt want to kill. it is an ACCIDENT" Do you think it would still be justice if you let the driver free from what he had did unintentionally yet there are those people who mourns for their love ones? Which is more heavier? An accident done by a drier who had no intentions of doing it or the loss of a love one?
Making an event as an accident cannot be a good reason. If this would be considered as an acceptable one, maybe most people who really are negligent in acts might just say, "IT WAS ACCIDENT". That reasoning might be used many many times and in te latter part would be used improperly. If we let this reasoning to be accepted, what would be the good things that will come out of it? How about the negative ones? Will the negative ones or the good ones be heavier in impact on each other? I think, Negative ones will out shine the other.
saying another example other than the driver above. If I were drunk and did plenty of stupid and brutal things, some of which maybe physical or just verbally, Do you think saying a reason that it is only accident would be acceptable? Even though it is true, 1 million percent true, that i did not intentionally and willfully (is my spelling right?) want to do the act?
One more thing. You are saying that it is unlawful that the official accused the driver with wreckless imprudence resulting to multiple homicide. If this is the case and you saying the it is somewhat not applying justice, I darefully say, THIS IS JUSTICE. It seems that the most appropriate case to be put on hand would be that one. Im no expert in the law, but those officials are more knowledgeable than me. So I reside with the decision. Ill ask you, WHAT DO YOU THINK WOULD BE THE APPROPRIATE CASE TO APPLIED TO THE MISFORTUNATE DRIVER?
one more point. In applying justice, you should not be biased. It seems you only agree with the condition of the driver. In this world, we are accountable in every little and complex things we accomplish. There will always be outcomes. And whatever outcomes might happen, we must face it.
And that's what the driver is experiencing. He must FACE it. If not, can he bring back the lives of those he had ACCIDENTALLY KILLED? the answer would always be NO! HAvent you realized that the event he had experienced would be lighter than the event experienced by those who cry their lungs out?
If this is justice, just disregarding the case of the other and having the other case with full point, the society would be more disorganized.
I FOLLOW THE RULES. IF I HAD MISTAKE, I FACE IT. RUNNING THROUGH THAT WOULDNT MAKE YOU GROW BUT THE SAME EVENT WOULD CROSS YOUR PATH OVER AND OVER AGAIN UNTIL YOU FINALLY FACE AND GIVE IT ANSWER.

wala namang bias nor unlawful dun eh... kung may ginawa kang againts the law, you should pay for it! Dun sa case naman ng driver, hindi lang naman basta violation of the law yung ginawa nia eh, maraming tao ang namatay because of his recklessness.And it is a big deal!

Wala namang ibang masisisi dyan kung hindi yung driver lang kasi nga sya yung may hawak ng manibela at may kontrol sa bus. Yes, kawawa ung driver pati na yung pamilyang umaasa sa kanya. Pero pano naman yung mga namatay pati na yung kanilang pamilya? kailangan nila ng hustisya. At kung hindi makukulong yung driver, yun ung unlawful and bias...

im not saying that the driver must be free! what i want is a lighter a punishment! do you think that is bias? the driver almost sacrifice his life to save his passenger!yun na nga ee pinipilit natin na may masisi tayu sa nagyare dahil nga wla tayong masisi! fortunately buhay yung driver kaya we keep on blaming him!and that is social prejudice! how to make a law? for sure it was based on how people think about an incident is it good? or bad? there is no exception i know! but for me there are still incidents we an use law,, and correct judgment! hindi natin dapat ikumpara and decision natin sa iba dahil may sarisarili tayong outlook sa mga nangyayare sa buhay natin.thanks for he comments :)

OPO. i 100% agree that it is biased. And hindi totoo na wala tayong masisi sa nangyari kasi aksidente. That is not true. May masisi tayo at yun yung driver.
May sinabi ka pa na there are still incidents na we can use law and correct judgment. BAkit sa tingin mo ba hindi LAW at correct judgment yung nanyari sa driver? Hindi naman magbibigay ng kaso ang mga officials na mali kung alam nilang di applicable yun sa nanyari e. And still you consider it as not correct judgment and not using law? Please explain this part of your side.

That is true. Absolutely true. pero kapag law na ang pinaguusapan, dapat fixed na. hindi pabagu bago. Iba outlook mo sa outlook ko sa nanyari. Pero pag batas, batas. Hindi na tayo pde pumili ng kung anu pa ang punishment na sa tngin natin ay tama at masasabing hindi ginamit ng tama ang batas at judgment.
PS. Magshut up na ako pag naexplain mo kung panu nangyaring hindi naging correct yung judgment at law sa ipanataw sa driver. PROMISE i will shut up pag naging clear sakin.

this is actually true. If fairness wasn't deliver properly, and the truth was ignored, then there will be NO JUSTICE at all! dati ku pren to napapansin sa mga balita. unfair nuh? TSK!
